By purchasing, using, assembling, modifying, installing, or allowing others to use any products sold by Nerpaskates, you acknowledge and accept that:

  • Product performance depends on many factors outside our control, such as user skill, maintenance, installation, environmental conditions, and proper use.
  • We do not guarantee specific athletic performance, race results, personal safety, or suitability for any particular activity.

You assume full responsibility for all risks arising from the use or misuse of our products. Nothing in this section is intended to exclude any liability that cannot legally be excluded under applicable Polish or EU law.

SECTION 5 – PRODUCT MODIFICATIONS AND CUSTOM SETUPS

Many of our products can be customized, sharpened, mounted, adjusted, or assembled according to your specifications. As the customer, you bear sole responsibility for:

  • Choosing the correct specifications and measurements.
  • Verifying compatibility with your equipment.
  • Carefully reviewing all custom configurations before use.

Custom-made, personalized, modified, sharpened, mounted, or specially ordered items are generally not eligible for return or exchange, except where mandatory consumer protection laws require otherwise.

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We appreciate your cooperation in providing current, complete, and accurate billing, shipping, and account information. Inaccurate information may lead to order cancellation, shipment delays, or account suspension.

To the maximum extent permitted by law, the risk of loss or damage to the products transfers to you once the shipment is handed over to the carrier. Please inspect your delivery promptly upon receipt and report any visible damage immediately with supporting documentation (photos, etc.).

  • Items that cannot be returned for hygiene or safety reasons once opened or used.

You are responsible for any diminished value of the goods caused by handling beyond what is necessary to check their nature, characteristics, and functioning. Refunds will be issued only after we have received and inspected the returned products in their original condition (where applicable). Please contact us before returning any item.

Nothing in these Terms limits or excludes our liability for death, personal injury caused by negligence, fraud, or any other liability that cannot legally be limited under applicable law.
